Terms of Service
Effective date: May 2, 2026
These Terms govern your access to and use of MerTek, including mertek.ai, the MerTek web app, downloads, the MerTek desktop app, update services, and related features operated by ManorSoft, Inc.
Acceptance
By using MerTek, creating an account, downloading the software, or accessing the service, you agree to these Terms. If you are using MerTek for an organization, you represent that you have authority to accept these Terms for that organization.
Accounts and Access
- You are responsible for account activity, credentials, local devices, and any access tokens or login sessions associated with your account.
- You must provide accurate account information and keep your contact information current when required for product operation or support.
- We may suspend or terminate access if we believe your account is compromised, abusive, unlawful, or creates risk for MerTek or other users.
Local Software and Updates
MerTek may include downloadable desktop apps, local runtime hosts, update tools, and release manifests. You are responsible for reviewing commands, permissions, updates, and local machine effects before allowing automated or agent-driven work to run.
User Content and Local Work
You keep ownership of your files, prompts, outputs, configuration, and other content. You grant MerTek the limited rights needed to process, transmit, store, display, troubleshoot, and support content you choose to send through the service. Local-only content remains under your control unless you submit, sync, upload, or share it.
Acceptable Use
- Do not use MerTek to violate laws, infringe rights, attack systems, bypass security, distribute malware, or abuse third-party services.
- Do not interfere with MerTek infrastructure, rate limits, update channels, authentication, or other users.
- Do not use the service to process data you are not authorized to use or share.
Third-Party Services
MerTek may connect to third-party AI providers, identity providers, hosting providers, package distribution services, and other integrations. Your use of those services may be subject to their separate terms and policies.
Intellectual Property
MerTek, MerTech, MerGen, MerBuf, and related software, designs, names, logos, documentation, and systems are owned by ManorSoft, Inc. or its licensors. These Terms do not transfer ownership of the product or its intellectual property to you.
Beta and Experimental Features
Some features may be preview, beta, experimental, incomplete, or subject to change. They may be modified, limited, or removed at any time.
Disclaimers
MerTek is provided on an "as is" and "as available" basis to the fullest extent permitted by law. We do not guarantee uninterrupted operation, error-free behavior, perfect security, or that agent outputs will be accurate, complete, or suitable for your use case.
Limitation of Liability
To the fullest extent permitted by law, ManorSoft, Inc. and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits; loss of data; business interruption; or local system changes resulting from your use of MerTek.
Changes
We may update these Terms as MerTek changes. The effective date above shows when this version was published. Continued use of MerTek after changes means you accept the updated Terms.
